OVERVIEW

Terms of Service

These Terms of Service apply to your use of The Brownie Bar Australia website and to purchases and enquiries made through our website.

By using our website or placing an order, you agree to these Terms of Service.

1. About Us

The Brownie Bar Australia is an Australian brownie business based in Bacchus Marsh, Victoria.

We create gourmet brownies and related gift products for individual customers, businesses, organisations and corporate clients.

2. Products

We take reasonable care to ensure that product descriptions, photographs and information displayed on our website are accurate.

Because our products are handmade, minor variations in appearance, colour, decoration and finish may occur.

Product availability may change from time to time. We reserve the right to make reasonable changes to products where necessary, including where an ingredient or decoration becomes unavailable.

3. Orders

An order placed through our website is subject to product availability and acceptance by The Brownie Bar Australia.

We reserve the right to contact you if there is an issue with your order, including availability, delivery requirements, payment or other circumstances that may affect fulfilment.

For corporate or large-volume orders, additional terms may apply and will be confirmed in the relevant quote, invoice or written agreement.

4. Corporate Orders

Corporate customers may submit an enquiry through our Corporate Gifting page.

Submitting an enquiry does not constitute acceptance of an order or guarantee product availability.

Corporate orders may be subject to minimum quantities, customised pricing, agreed payment terms, production lead times and delivery arrangements.

Where applicable, these details will be confirmed in writing before the order is finalised.

5. Pricing and Payment

Prices displayed on our website are in Australian dollars and include GST where applicable.

Prices may change without notice; however, the price applicable to an accepted order will be confirmed at the time of purchase or in the relevant quote or invoice.

Payment must be made using the payment method or payment terms agreed at the time of purchase.

Corporate customers approved for invoicing must comply with the payment terms stated on their invoice.

6. Delivery

We use Australia Post Express and other delivery arrangements where appropriate.

Delivery timeframes provided by The Brownie Bar Australia are estimates only and may be affected by circumstances outside our reasonable control, including postal delays, weather, transport disruptions and other unforeseen events.

Customers are responsible for providing accurate delivery information.

We cannot be responsible for delays caused by incorrect or incomplete delivery information supplied by the customer.

For corporate orders involving multiple recipients or delivery addresses, delivery arrangements and associated charges will be confirmed separately.

7. Product Storage and Consumption

Our brownies are made fresh and should be stored and consumed in accordance with the storage information provided with your order.

Customers are responsible for following any storage instructions supplied with the products or on the website.

Because brownies are food products, customers should check the ingredient and allergen information provided before consumption.

8. Allergens and Dietary Requirements

Our products may contain or come into contact with common allergens.

While we offer selected dietary options, including gluten-free and vegan products, customers should review the relevant product information and contact us before ordering if they have a food allergy or specific dietary requirement.

We cannot guarantee an allergen-free environment.

9. Cancellations and Changes

Because our products are handmade and may be prepared specifically for a particular delivery date, cancellation or modification of an order may not always be possible once production has commenced.

Customers should contact us as soon as possible if they need to change or cancel an order.

Any cancellation, refund or change will be handled in accordance with applicable Australian Consumer Law.

10. Damaged or Incorrect Orders

If your order arrives damaged, incorrect or otherwise not as expected, please contact us as soon as reasonably possible and provide relevant details and photographs where appropriate.

We will assess the issue and work with you to provide an appropriate remedy where required by law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law.

11. Photography and Social Media

From time to time, The Brownie Bar Australia may photograph or otherwise create images of products, packaging, corporate gift orders or events for promotional, marketing and social media purposes.

Where photographs or other visual content contain personal information or an identifiable individual, we will only use or publish that content where we have an appropriate legal basis to do so, including obtaining consent where required.

For photographs of products, gift boxes, packaging and completed orders, you acknowledge and agree that The Brownie Bar Australia may photograph and use such images for its own marketing and promotional purposes, including on its website, social media accounts, advertising and other promotional materials, provided that reasonable steps are taken to ensure that individuals are not reasonably identifiable and that personal or confidential information is not disclosed.

This may include photographs showing corporate gift boxes, products, packaging, branding or order presentation. We may edit, crop or otherwise modify such photographs for marketing purposes.

We will not intentionally publish names, contact details, delivery addresses, order information or other confidential customer information in connection with such photographs without appropriate consent.

Where a photograph has been appropriately de-identified so that an individual is not reasonably identifiable, it may be used by The Brownie Bar Australia for the purposes described above.

If you provide photographs or other content to The Brownie Bar Australia for marketing purposes, you confirm that you have the necessary rights and permissions to provide that content to us and to permit its use for the purposes for which it is provided.

12. Intellectual Property

All content on this website, including photographs, product descriptions, branding, logos, graphics and written material, belongs to or is licensed to The Brownie Bar Australia unless otherwise stated.

You must not reproduce, copy, modify, distribute or commercially use our content without our prior written permission.

13. Website Use

  • reproduce or misuse website content without permission.

14. Links to Third-Party Websites

Our website may contain links to third-party websites or services.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

Your use of third-party websites is subject to their own terms and policies.

15. Limitation of Liability

To the extent permitted by law, The Brownie Bar Australia will not be liable for losses arising from circumstances outside our reasonable control.

Nothing in these Terms limits or excludes any liability or consumer guarantee that cannot legally be limited or excluded under Australian law.

16. Australian Consumer Law

Nothing in these Terms is intended to exclude, restrict or modify rights and remedies available to consumers under the Australian Consumer Law or any other applicable law.

Where the Australian Consumer Law provides a mandatory right, guarantee or remedy, that right, guarantee or remedy continues to apply.

17. Privacy

Personal information collected through our website is handled in accordance with our Privacy Policy.

18. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our business, website or legal obligations.

The current version will be published on our website.
